By accessing or using Digital Dram ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Age Requirement

You must be at least 21 years of age to use Digital Dram. By using the Service, you represent and warrant that you are at least 21 years old. We reserve the right to terminate accounts of users who misrepresent their age.

This Service is intended solely for users who are of legal drinking age in the United States. The content on Digital Dram is related to alcoholic beverages and is not intended for minors.

To access certain features of the Service, you must create an account. You agree to:

• Accept responsibility for all activities that occur under your account

• Harass, abuse, or harm other users
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use automated systems or software to extract data from the Service
• Engage in any activity that could damage, disable, or impair the Service

5. User Content

Users may submit content including bourbon reviews, drop reports, collection information, and other materials ("User Content"). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe any third-party rights
• Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content that violates these Terms or that we find objectionable.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by Digital Dram and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Location Data Collection

By using Digital Dram, you consent to the collection of device location data when you:

• Report bourbon drops (drop reports)
• Create community posts
• Use location-based features

What location data we collect:

• Latitude and longitude coordinates from your device GPS
• Elevation (altitude) when available
• Location accuracy measurements (GPS precision)
• Timestamp of when location was captured

How we use location data:

• Verify authenticity of drop reports and posts
• Calculate distance between you and reported stores
• Provide location-based analytics and insights
• Show nearby bourbon finds and community activity
• Detect fraudulent or suspicious activity
• Improve service quality and user experience

Location data privacy:

• Your exact device location is never displayed publicly
• Only store locations (not your personal location) are shown to other users
• Location data is used for analytics in aggregate form only
• You can deny location permissions, but some features may be limited

International Users: If you are located in the European Economic Area (EEA), United Kingdom, or other jurisdictions with specific location data privacy laws, you have additional rights regarding your location data as outlined in our Privacy Policy. We will obtain your explicit consent before collecting location data where required by law.

California Residents: Under the California Consumer Privacy Act (CCPA), you have the right to know what personal information (including location data) is collected, request deletion of your data, and opt-out of sale of personal information. Digital Dram does not sell your location data to third parties.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Digital Dram. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

The Service integrates with various third-party services including but not limited to:

• Google Maps for location services
• Firebase for authentication and analytics
• Payment processors for premium features (if applicable)

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• The information provided through the Service is accurate, reliable, or complete
• Any defects or errors will be corrected
• The Service will meet your requirements or expectations

Bourbon availability information is provided by users and may not be accurate or current. Always verify availability with retailers directly.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL DRAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, or similar harmful code transmitted through the Service
• Any errors or omissions in any content
• User Content posted on the Service

In no event shall our aggregate liability exceed the amount you paid, if any, for accessing the Service in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Digital Dram, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your violation of any third-party rights
• Your User Content

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Dispute Resolution

Arbitration Agreement: Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the state where our headquarters are located.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Small Claims Court: Notwithstanding the above, either party may bring an individual action in small claims court.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which our headquarters are located, without regard to conflict of law provisions.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Digital Dram regarding the use of the Service, superseding any prior agreements.
