Digital Dram Terms of Service

1. Acceptance of Terms

By accessing or using Digital Dram (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 21 years old to use Digital Dram.

By using the Service, you represent and warrant that:

• You are of legal drinking age in your jurisdiction
• You will use the Service in compliance with all applicable laws

3. Accounts

To access core features, you must create an account.

You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be responsible for all activity under your account

We may suspend or terminate accounts that violate these Terms.

4. Description of Service

Digital Dram is a bourbon-focused platform that enables users to:

• Track and manage their collection
• Record tasting notes and ratings
• Discover and report bourbon drops
• Receive personalized recommendations ("Bourbon DNA")
• Participate in community-driven features

The Service is provided for informational and entertainment purposes only.

5. Subscriptions and Payments

Digital Dram may offer optional paid subscriptions.

• Subscriptions are billed through Apple's App Store or Stripe
• Payment is handled by the respective platform, not Digital Dram directly
• Subscriptions automatically renew unless canceled
• You can manage or cancel subscriptions through your Apple account settings or the Digital Dram web app

For subscriptions purchased through the Apple App Store, Apple's standard Licensed Application End User License Agreement (EULA) applies. In the event of any conflict between these Terms and Apple's EULA, Apple's EULA shall govern with respect to the iOS application.

We do not store or process payment card information.

6. User Content

You may submit content including:

• Reviews and ratings
• Tasting notes
• Collection data
• Drop reports
• Photos

You retain ownership of your content, but you grant Digital Dram a:

Worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with the Service

You agree that your content:

• Is accurate and not misleading
• Does not violate any laws or third-party rights
• Does not contain harmful, abusive, or inappropriate material

We may remove content that violates these Terms.

7. Acceptable Use

You agree not to:

• Violate any laws or regulations
• Promote illegal or underage alcohol use
• Submit false or misleading drop reports
• Harass or harm other users
• Attempt to access systems without authorization
• Use bots, scraping tools, or automated systems
• Interfere with the operation of the Service

8. Location-Based Features

Some features use your device's location (with your permission), including:

• Nearby store discovery
• Location-based drop alerts

By enabling location services, you consent to this use.

Important:

• Your precise location is not shared publicly
• Location is used only to power app functionality and personalization
• You can disable location permissions at any time in your device settings

9. Third-Party Services

The Service relies on third-party providers, including:

• Apple App Store (distribution, in-app purchases, subject to Apple's EULA)
• Stripe (web payment processing)
• Firebase (authentication, analytics, diagnostics)
• Google Cloud (infrastructure, maps, image storage)

These services operate under their own terms and privacy policies.

10. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Digital Dram and protected by intellectual property laws.

You may not:

• Copy, modify, or distribute the Service
• Reverse engineer or attempt to extract source code

11. Trademark Notice

"All product names, trademarks, and brands are property of their respective owners."

Digital Dram is not affiliated with, endorsed by, or sponsored by any distillery, brand, or retailer unless explicitly stated.

12. Disclaimers

The Service is provided "as is" and "as available."

We do not guarantee:

• Accuracy of user-submitted content
• Availability of products reported in the app
• That the Service will be uninterrupted or error-free

Users should independently verify product availability and details.

13. Limitation of Liability

To the maximum extent permitted by law, Digital Dram shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or goodwill
• Errors in user-generated content
• Actions taken based on information from the Service

14. Termination

We may suspend or terminate your access at any time if you violate these Terms.

Upon termination:

• Your right to use the Service ends immediately
• Certain provisions (e.g., liability, IP) will survive

15. Privacy

Your use of the Service is governed by our Privacy Policy.

We do not:

• Sell your personal data
• Use your data for third-party advertising
• Track you across apps or websites

16. Governing Law

These Terms are governed by the laws of the United States and the Commonwealth of Virginia, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes will be resolved through:

• Binding arbitration on an individual basis
• No class action or representative claims

You may bring claims in small claims court where permitted.

18. Responsible Use

Digital Dram promotes responsible enjoyment of alcohol.
